Welcome to the game services (such as "Street Wars: Basketball", "Royal Go") provided by Kokoa Studio Limited (hereinafter referred to as "we" or "us"). Please read and understand these Terms carefully before using our games. By starting or continuing to use our games, you indicate that you have read, understood, and agree to be bound by all the provisions of these Terms. If you do not agree to any part of these Terms, please stop using our games immediately. 🎮
1. Eligibility Requirements and Account Information
a. During the registration process, you may be required to provide an email address and set a username and password. You agree to provide true, accurate, and up-to-date information and to maintain the accuracy of such information on an ongoing basis.
b. Account ownership belongs to Kokoa, and you are granted only a limited, non-transferable license to use the account.
c. You are responsible for safeguarding your account login credentials. You shall bear sole responsibility for any activities conducted through your account.
d. You may not transfer, sell, or gift your account to any other person, unless you obtain our express written permission.
2. User Content and Code of Conduct
a. "User Content" refers to any text, data, images, audio, video, or other content that you upload, transmit, or submit through our services.
b. You bear full responsibility for the User Content you create and must ensure that it does not infringe upon any third party's intellectual property rights, privacy rights, portrait rights, or other legal rights, and that it does not contain any illegal, infringing, obscene, harassing, defamatory, violent, or discriminatory content.
c. You shall not:
(i) Use cheating tools, hacking tools, or other unauthorized means to interfere with the normal operation of the game;
(ii) Engage in fraud, false transactions, or abuse of the payment system;
(iii) Distribute viruses, malicious code, or launch cyberattacks;
(iv) Impersonate any other person, or falsely claim affiliation with any individual or entity;
(v) Collect personal information of other users;
(vi) Send spam messages or engage in commercial promotion;
(vii) Engage in any conduct that violates applicable laws and regulations.
d. We reserve the right to monitor User Content and to take appropriate measures in response to violations of these Terms. Such measures include removing relevant content, restricting certain features, and suspending or terminating user accounts.
3. Virtual Items and Payment Methods
a. Virtual currencies, items, equipment, and other similar in-game assets (collectively, "Virtual Items") may only be used within the designated game and have no real-world monetary value.
b. When you purchase Virtual Items, you are granted a limited, non-transferable license to use such Virtual Items, but you do not own them. These Virtual Items may not be exchanged for cash, physical goods, or anything else of value.
c. All purchases are generally final and non-refundable, unless otherwise required by applicable law or at our sole discretion.
d. Upon termination of an account (whether voluntarily deleted or terminated due to a violation of these Terms), any associated Virtual Items will become inaccessible and cannot be restored. For accounts that have been inactive and not logged into for 3 consecutive years, the virtual currency in the system may be reclaimed by the system.
e. All transactions are processed through third-party payment platforms, such as the Apple App Store and Google Play Store. For billing and transaction records, please refer to the relevant information provided by these platforms.
4. Intellectual Property
a. All content within our games, websites, logos, graphics, audio, video, and code (collectively, "Kokoa Content") constitutes the intellectual property of Kokoa or its licensors.
b. You may use Kokoa Content solely for personal, non-commercial purposes, provided that you comply with these Terms.
c. You retain ownership of the User Content you create; however, you grant Kokoa a worldwide, royalty-free license to use, display, store, and distribute such content as necessary for the provision of the relevant services.
d. Any feedback, suggestions, or ideas you provide shall be owned by Kokoa without any compensation payable to you.
5. Disclaimers and Limitation of Liability
a. Our services are provided on an "as is" basis, without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
b. We cannot guarantee that the services will be uninterrupted, error-free, or completely secure. We shall not be liable for any service interruption or data loss caused by network, device, or third-party service issues.
c. All plots, settings, and worldviews within the game are virtual content designed solely to enhance the gaming experience. Such content does not represent the positions of Kokoa or any third party in the real world, nor does it constitute any evaluation or depiction of any real-world individual, group, or event.
d. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, punitive, or consequential damages, regardless of the legal basis asserted. Our total liability shall not exceed USD 100.
6. Prohibited Activities and Content
(a) Prohibition of Cheating
We expect all users to enjoy a positive and fair gaming experience when using the services. You shall not engage in any form of cheating:
(i) Creating, distributing, promoting, or using unauthorized software or tools, including automation programs, macros, cheat tools, cracking programs, etc., that are designed to provide unfair advantages or alter the normal operation of the game;
(ii) Exploiting, sharing, or disseminating information about game errors, glitches, vulnerabilities, or any technical malfunctions that may result in unintended advantages, such as repeatedly obtaining one-time promotional offers.
If you become aware of any of the above, you must notify Kokoa immediately.
(b) Prohibited Activities
In addition to the other restrictions set forth in these Terms, you shall not, and shall not assist or encourage others to, engage in any of the following activities (all of the activities listed below, whether individually or in combination, constitute "Prohibited Activities"):
(i) Violating these Terms and/or any supplementary terms, or any applicable laws, contracts, intellectual property rights, or other third-party rights;
(ii) Engaging in any harassing, threatening, intimidating, predatory, or stalking behavior;
(iii) Soliciting or collecting personal information from other users;
(iv) Accessing the game if you have not reached the minimum age requirement we have set for the game;
(v) Using or attempting to use another user's account or information without authorization from both the other user and us;
(vi) Impersonating any individual or entity, or falsely stating an affiliation with any individual or entity;
(vii) Creating multiple accounts;
(viii) Selling or reselling our services or your account without our written permission, including through renting, leasing, buying, selling, gifting, or otherwise transferring or sharing your account;
(ix) Copying, reproducing, distributing, publicly performing, or publicly displaying all or any part of our services, unless expressly authorized by us or our licensors;
(x) Modifying the content of our services; removing any of our rights notices or logos; or creating any derivative works based on our services;
(xi) Using our services in any manner that may interfere with, disrupt, or negatively affect other users' use of the services; or in any manner that may damage or cause the services to malfunction;
(xii) Reverse engineering any part of our services, or taking any action that may expose source code, or bypass or circumvent security measures designed to prevent or restrict access to any part of the services;
(xiii) To the maximum extent permitted by applicable law, you shall not: (A) use any data mining, robots, or other data collection or extraction methods to scrape or extract data from our services, except for compiling results for public search engines in accordance with our robots.txt file; (B) use our services, or any data published within, obtained through, or accessed via the services, to develop, train, fine-tune, or validate any artificial intelligence system or model, or for any other purpose not expressly permitted under these Terms. We do not consent to the use of the services or any data therein for the aforementioned purposes;
(xiv) Developing or using any application or software that interacts with our services, without our prior written permission;
(xv) Sending, distributing, or posting spam, unsolicited mass commercial electronic communications, chain letters, or pyramid schemes;
(xvi) Linking to any online portion of the services in a manner that damages or exploits our reputation, or that implies any form of affiliation, endorsement, or support by Kokoa;
(xvii) Using any application programming interface ("API") we provide in a manner that does not comply with the accompanying API documentation;
(xviii) Using the services to design or develop similar or competing products.
(c) Multiple Accounts
You shall not create multiple accounts for any game, which constitutes a Prohibited Activity and a violation of these Terms. Any attempt to manipulate or unfairly influence the services is also strictly prohibited.
(d) Prohibited Content
You shall not create, post, store, or share any User Content to which you do not hold all rights. You must ensure that your User Content, and our use thereof, does not infringe upon the rights of any person or entity, including third-party rights, and does not cause harm to any person or entity. You shall not create, post, store, or share any of the following types of content:
(i) Any content involving defamation, slander, abuse, obscenity, pornography, inappropriate expressions, vulgarity, harassment, threats, violence, invasion of privacy, or violation of publicity rights; and any statements that demean specific racial, ethnic, gender, or religious groups;
(ii) Content that may constitute, encourage, or provide instructions for criminal activity, or that violates the rights of any party, or that violates these Terms;
(iii) Content containing or describing any statements, comments, or claims that do not reflect your genuine opinions and experiences;
(iv) Content containing any third party's private or personal information without the consent of such third party;
(v) Content containing any viruses, corrupted data, or other malicious, destructive, or harmful files or content;
(vi) Any content that, in our reasonable judgment, is objectionable, or that restricts or interferes with other users' use of our services, or that may cause Kokoa or others to suffer any form of damage or liability;
(vii) Content containing links to other content that, if such linked content were User Content, would violate any of the foregoing restrictions.
(e) Enforcement
This Section 6 does not create any rights or causes of action for any third party, nor does it create any reasonable expectation that the services will not contain activities or content prohibited by these Terms, or that prohibited content will be immediately removed upon posting. We have the right to:
(i) Remove or delete User Content, or refuse to publish any User Content, at any time, without prior notice, including for violations of these Terms;
(ii) Terminate, delete, modify, or suspend your access to all or part of the services, whether temporarily or permanently, if your activities or User Content are reasonably likely to violate these Terms;
(iii) At Kokoa's sole discretion, take any necessary measures to address your User Content to ensure compliance with applicable laws and these Terms, or to protect the rights of Kokoa and/or third parties, including third-party intellectual property and privacy rights (e.g., providing information to rights holders who submit takedown requests);
(iv) Fully cooperate with any law enforcement agency or court order regarding activities or content related to the services, in accordance with applicable law.
(f) Complaints and Appeals
If you have any concerns or dissatisfaction regarding any User Content or the actions we have taken in relation to such content, you may submit an appeal through the ShireHub platform or contact customer support through the relevant in-game support channel. We will endeavor to process your complaint or issue as promptly as possible in accordance with our internal policies and procedures. If you are not satisfied with our initial response, you have the right to submit additional information or evidence in support of your claim. We will re-evaluate your appeal and notify you of the final result. Our decision on your appeal shall be final and binding.
7. Abnormal Behavior Handling and Compensation Mechanism
a. Identification of Abnormal Behavior
To safeguard game fairness and the legitimate rights and interests of all users, we have established a multi-dimensional game behavior monitoring system that continuously analyzes various user behaviors during the use of the services. When we determine, based on such monitoring system, that an account has engaged in abnormal behavior, we shall have the right to take corresponding measures in accordance with these Terms.
b. Temporary Account Restriction
From the date of determination of abnormal behavior, your account will be temporarily restricted from logging in for 7 days. You understand and agree that during this restriction period, any time-based services you have purchased (including but not limited to monthly passes and other time-based or efficiency-based entitlements) will continue to be consumed and counted toward their validity period, and we shall not provide compensation or extensions.
c. Compensation Liability
Upon expiration of the 7-day restriction period, you will see a compensation amount screen upon login. You must complete the compensation payment as prompted on the screen in order to restore normal account use.
Such compensation is not the purchase price for Virtual Items, but rather constitutes damages for breach of contract arising from your abnormal behavior, which has caused consumption of service resources, increased system load, elevated operational costs, and adverse effects on the fairness of other users. The compensation amount shall be reasonably determined by us based on the nature, severity, and impact of the abnormal behavior.
d. Compensation Execution
If you fail to complete the payment within 15 days after the compensation screen is displayed, we reserve the right to permanently terminate your account. Any associated Virtual Items will be handled in accordance with Section 3(d) of these Terms and shall not be restored.
e. Dispute Resolution
If you have any objection to the determination of abnormal behavior or the compensation amount, you may submit an appeal through the ShireHub platform within 7 days after the compensation screen is displayed. We will re-examine the relevant data and make a final decision. During the appeal period, the account status shall remain unchanged.
8. Privacy Protection
We take your privacy and security very seriously. We will collect, use, store, and process your personal information in accordance with our Privacy Policy. Please read and understand the contents of the Privacy Policy before using our services.
9. Modification and Termination of Terms
a. We reserve the right to modify these Terms at any time. The modified Terms will be announced within the game or published on our official website. If you continue to use the services, you are deemed to have accepted the modified Terms.
b. You may delete your account through the in-game settings function or by contacting customer support.
c. If we determine that you have violated these Terms, or that your behavior may cause harm to our services, other users, or third parties, we reserve the right to suspend or terminate your account without prior notice.
10. Third-Party Services and Links
Our services may contain links, content, or applications provided by third parties. These third-party services have their own independent terms and privacy policies, which you should carefully read and understand. We cannot be responsible for the content, accuracy, availability, or security of these third-party services.
11. Governing Law and Dispute Resolution
a. These Terms shall be governed by the laws of the People's Republic of China.
b. Any dispute arising in connection with these Terms shall first be attempted to be resolved through amicable negotiation. If negotiation fails, either party may submit the dispute to arbitration in Beijing in accordance with the arbitration rules of the China International Economic and Trade Arbitration Commission (CIETAC) as in effect at that time. The arbitral award shall be final and binding on both parties.
12. Miscellaneous
a. These Terms constitute the entire agreement between you and us regarding the use of the services, superseding all prior or contemporaneous oral or written agreements.
b. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
c. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
